Kelpie Music (en adelante, LA PRODUCTORA) realizar\u00e1 en tal caso las gestiones necesarias y sumar\u00e1 al precio del servicio los honorarios correspondientes al trabajo externo, <strong>previo<\/strong> <strong>acuerdo <\/strong>con EL CLIENTE.<\/li>\n<li style=\"margin-bottom: 1em;\">Los <strong>precios<\/strong> de aquellos <strong>proyectos <\/strong>que sean evaluados y considerados por LA PRODUCTORA como <strong>especialmente complejos<\/strong>, ya sea por volumen de trabajo excepcional o requerimiento de un tiempo superior a la media habitual en su finalizaci\u00f3n, estar\u00e1n sujetos a una <strong>renegociaci\u00f3n al alza<\/strong>.<\/li>\n<li style=\"margin-bottom: 1em;\">Una vez pactados los t\u00e9rminos en los que va a desarrollarse la creaci\u00f3n de la <strong>primera obra<\/strong>, LA PRODUCTORA requerir\u00e1 un <strong>dep\u00f3sito de al menos el 50%<\/strong> del precio final AL CLIENTE, previo al comienzo del trabajo, aunque <strong>puede elegir realizar el pago completo<\/strong> si as\u00ed lo prefiere. Los honorarios correspondientes a posibles aportaciones de int\u00e9rpretes externos han de abonarse en su totalidad en este plazo.<\/li>\n<li style=\"margin-bottom: 1em;\">Si EL CLIENTE no abona el coste completo antes del comienzo de la producci\u00f3n, deber\u00e1 realizar <strong>el pago final<\/strong> en los <strong>15 d\u00edas posteriores a la entrega<\/strong> de la obra.<\/li>\n<li style=\"margin-bottom: 1em;\">Los <strong>packs ORO<\/strong> y <strong>PLATA<\/strong> son <strong>combinables<\/strong> con cualquiera de los packs <strong>AHORRO<\/strong>. El pack <strong>TARIFA PLANA<\/strong> <strong>no<\/strong> es <strong>acumulable<\/strong> con otros packs u ofertas.<\/li>\n<li style=\"margin-bottom: 1em;\">Los <strong>precios <\/strong>que se establecen en el resumen mostrado en esta web est\u00e1n sujetos a <strong>cambios sin previo aviso<\/strong>.<\/li>\n<li>Cualquiera que sea el servicio contratado, el <strong>master<\/strong> se enviar\u00e1 en <strong>cualquier formato o formatos digitales<\/strong> a elecci\u00f3n DEL CLIENTE. En ese caso, se reclamar\u00e1 el <strong>3% de las ventas<\/strong>, que es el procedimiento est\u00e1ndar en la industria.<\/li>\n<li style=\"margin-bottom: 1em;\">En el caso de los <strong>remixes<\/strong>, LA PRODUCTORA <strong>conservar\u00e1 los cr\u00e9ditos de composici\u00f3n<\/strong>, as\u00ed como sus <strong>derechos derivados<\/strong>, al respecto de los arreglos musicales ejecutados por ella y que, por tanto, no est\u00e9n contenidos en la obra original.<\/li>\n<li style=\"margin-bottom: 1em;\">En el caso de <strong>producci\u00f3n musical para audiovisuales<\/strong>, los <strong>cr\u00e9ditos de composici\u00f3n<\/strong> \u2013 y derechos derivados \u2013 pertenecer\u00e1n invariablemente al <strong>compositor\/productor<\/strong>. \u00danicamente se <strong>ceder\u00e1n<\/strong> los derechos para el <strong>proyecto previsto<\/strong>.<\/li>\n<li style=\"margin-bottom: 1em;\">Bajo este mismo supuesto, la <strong>cesi\u00f3n de los derechos patrimoniales<\/strong> de la obra producida se considerar\u00e1, de forma general, <strong>exclusiva<\/strong>, <strong>y sin l\u00edmites temporales o territoriales<\/strong>. No obstante, existe la posibilidad de <strong>descuento del 20%<\/strong> en la tarifa del servicio si se pacta una <strong>cesi\u00f3n no exclusiva<\/strong> de la obra, permiti\u00e9ndose as\u00ed a LA PRODUCTORA ceder dichos derechos de nuevo a terceras personas f\u00edsicas o jur\u00eddicas. Otras posibilidades de descuento pueden ser pactadas con el cliente estableciendo <strong>l\u00edmites temporales y\/o territoriales<\/strong> a la cesi\u00f3n.<\/li>\n<li style=\"margin-bottom: 1em;\">Los <strong>precios<\/strong> de la producci\u00f3n musical ofrecida por LA PRODUCTORA corresponden a proyectos que incluyen \u00fanicamente <strong>instrumentaci\u00f3n no real<\/strong>. Por lo tanto, tal y como se especifica en los t\u00e9rminos y condiciones generales, <strong>los gastos de contrataci\u00f3n de elementos externos<\/strong> corresponder\u00e1n AL CLIENTE y deber\u00e1n ser satisfechos en la manera y tiempo en la que en dichos t\u00e9rminos y condiciones se expone.<\/li>\n<li>LA PRODUCTORA cuenta con una <strong>red de estudios de grabaci\u00f3n asociados<\/strong> en algunas de las principales ciudades de Espa\u00f1a que ser\u00e1n ofrecidos AL CLIENTE en caso de requerir un <strong>registro profesional de voz o instrumentaci\u00f3n real <\/strong>por su parte para completar la producci\u00f3n. Este precio ser\u00e1 <strong>discutido y firmado en contrato legal<\/strong> con EL CLIENTE, previo al comienzo de los trabajos.<\/li>\n<li style=\"margin-bottom: 1em;\">Al contratar cualquiera de nuestros servicios para <strong>MEZCLA CREATIVA<\/strong>, EL CLIENTE asume la <strong>obligaci\u00f3n de proporcionar<\/strong> los temas y\/o recursos que servir\u00e1n de <strong>material<\/strong> para la obra mezclada que se adquiere.<\/li>\n<li style=\"margin-bottom: 1em;\">LA PRODUCTORA<strong> no vende m\u00fasica<\/strong> de la cual no ostente los <strong>derechos<\/strong> pertinentes para su comercializaci\u00f3n. El servicio por el que se le contrata, y por la que se le paga, es por la <strong>acci\u00f3n de mezcla<\/strong> <strong>y transformaci\u00f3n <\/strong>sobre los temas <strong>proporcionados previamente por EL CLIENTE<\/strong>.<\/li>\n<li style=\"margin-bottom: 1em;\">Al tratarse de <strong>modificaciones no contempladas en la ley<\/strong>, el concepto de \u201ccopyright\u201d no es aplicable a \u00e9stas, sino a los temas musicales contenidos. EL CLIENTE <strong>es el \u00faltimo y \u00fanico responsable del uso<\/strong> que se da a la obra adquirida, incluida su reproducci\u00f3n, copia y posible difusi\u00f3n.<\/li>\n<li style=\"margin-bottom: 1em;\">Con el objeto de garantizar lo expuesto en el punto anterior, en el contrato entre PRODUCTORA y CLIENTE se incluir\u00e1 una <strong>cl\u00e1usula de descargo de responsabilidad<\/strong> que eximir\u00e1 a LA PRODUCTORA de posibles acciones legales originadas por la potencial difusi\u00f3n o comercializaci\u00f3n indebida de la pista entregada.<\/li>\n<li style=\"margin-bottom: 1em;\">LA PRODUCTORA no precisa que EL CLIENTE sea el propietario o cesionario de los derechos del material proporcionado. Si EL CLIENTE no ostenta tales derechos, LA PRODUCTORA, como empresa, requerir\u00e1 <strong>no ser mencionada<\/strong> expl\u00edcita o impl\u00edcitamente en ning\u00fan medio usado para una <strong>posible difusi\u00f3n p\u00fablica<\/strong> de la obra por parte del CLIENTE, aunque s\u00ed solicitar\u00e1 que el realizador, como persona f\u00edsica, sea referenciado.<\/li>\n<li>Si EL CLIENTE es el <strong>propietario o cesionario de los derechos<\/strong> \u2013 incluidos los de fragmentaci\u00f3n \u2013 <strong>del material proporcionado<\/strong>, y la obra va a formar parte de un <strong>lanzamiento comercial<\/strong> por parte de una editorial o sello discogr\u00e1fico, LA PRODUCTORA requerir\u00e1 ser <strong>mencionada expl\u00edcitamente<\/strong> como estudio productor de la obra, en forma pactada con el cliente y plasmada en el correspondiente contrato.
